Your (“You” or “Your”) use of the Stakehub Platform is subject to the terms and conditions set forth in these Terms of Use.
By accessing, using, or signing up for the Stakehub Platform, you acknowledge and agree that you shall be subject to the policies that are applicable to the Platform and by mere use of the Platform, you shall be contracting with Stakehub, and these Terms of Use including the policies constitute your binding obligations with Stakehub. Your use of the Stakehub Platform indicates your acceptance of these Terms.
Stakehub respects your privacy and is committed to protecting your personal information. Your use of the Stakehub Platform is subject to Stakehub's Privacy Policy, which outlines our practices regarding the collection, use, and disclosure of your personal information. The Stakehub Platform and all the information, content, and materials available on it are provided "as is" and "as available" without any express or implied warranties of any kind. Stakehub disclaims all warranties, whether express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade. We make no representations or warranties with regard to the accuracy, completeness, non-infringement, or fitness for a particular purpose of any information, content, and/or material available on the Stakehub Platform.
All content, features, and functionality on the Stakehub Platform, including but not limited to, text, graphics, logos, icons, images, and software, are the exclusive property of Stakehub or its licensors and are protected by copyright, trademark, and other intellectual property laws. As long as you comply with these Terms of Use, we grant you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Stakehub Platform solely for your personal, non-commercial use, subject to these Terms.
You agree to use the Stakehub Platform only for lawful purposes and in accordance with these Terms. You are prohibited from using the Stakehub Platform in any manner that violates any applicable law, regulation, or the rights of Stakehub or others. You must not engage in any activity that interferes with, disrupts, or negatively affects the Stakehub Platform, its users, or its services.
Stakehub reserves the right, in its sole discretion, to terminate or suspend your access to the Stakehub Platform, without notice, for breach or violation of these Terms of Use, upon request by law enforcement or other government agencies, upon request by you, or for other valid reasons as determined by Stakehub.
In no event shall Stakehub, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Stakehub Platform.
You agree to defend, indemnify, and hold harmless Stakehub and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use and access of the Stakehub Platform or a breach of these Terms.
The Stakehub Platform may contain links to third-party websites or services that are not owned or controlled by Stakehub. Stakehub has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Stakehub shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third-party websites or services.
These Terms of Use constitute the entire agreement between you and Stakehub concerning your use of the Stakehub Platform and supersede any prior agreements, communications, or discussions (oral or written) between you and Stakehub.
These Terms shall be governed by the laws of India without regard to its conflict of law provisions. The courts in Jaipur, Rajasthan, India shall have exclusive jurisdiction to settle any disputes arising out of or in connection with these Terms.
Stakehub reserves the right, in its sole discretion, to modify, discontinue, or terminate any or all aspects of the Stakehub Platform or to modify these Terms at any time and without prior notice. If we modify these Terms, we will post the modification on the Stakehub Platform. By continuing to access or use the Stakehub Platform after we have posted a modification, you agree to be bound by the modified Terms.
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Stakehub's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
The Stakehub Platform is operated and controlled by Stakehub in India. Access to the Stakehub Platform from countries or territories where such access is illegal is prohibited. If you access the Stakehub Platform from outside India, you are solely responsible for compliance with local laws.
Stakehub shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labor or materials.
Any dispute arising out of these Terms of Use, including disputes relating to the applicability or validity of these Terms, will be resolved by binding arbitration as described in the Arbitration Agreement section of these Terms.
You and Stakehub agree to arbitrate any dispute arising from these Terms or relating to the Stakehub Platform, except that you and Stakehub are not required to arbitrate any dispute in which either party seeks equitable and other relief for the alleged unlawful use of copyrights, trademarks, trade names, logos, trade secrets, or patents.
You may not assign or transfer these Terms, by operation of law or otherwise, without Stakehub's prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null and of no effect. Stakehub may freely assign or transfer these Terms without restriction.
If any provision of these Terms of Use is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision will be modified to the extent necessary to render it enforceable and to preserve the parties' intentions or, if this is not possible, severed, and the remaining portions of these Terms of Use will remain in full force and effect.
The sections regarding restrictions on your use of the Stakehub Platform, Stakehub's intellectual property rights, disclaimers of warranties, limitations of liability, your indemnity obligations, dispute resolution, and general terms will survive the termination of these Terms of Use for any reason.
These Terms of Use and any action related to these Terms of Use will be governed by the laws of India, without regard to its conflict of laws principles.
By using the Stakehub Platform, you agree to receive certain electronic communications from us, as further described in our Privacy Policy. Please read our Privacy Policy to learn more about your choices regarding our electronic communications practices. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.
Stakehub reserves the right to make changes to its Website and these Terms of Use at any time. Your continued use of the Stakehub Platform following the posting of changes to these Terms of Use indicates your consent to those changes.
Notices to you may be made via email or regular mail or, in cases of changes to these Terms of Use or to the services offered by the Stakehub Platform, by posting notices or links to such notices on the Stakehub Platform itself.
